Welcome to Baytora. By accessing or using our platform to list, buy, sell, or rent properties in Dubai, you agree to these terms and conditions, designed to ensure compliance with Dubai Land Department (DLD) and Real Estate Regulatory Authority (RERA) guidelines.

1. Scope of Services
1.1. Baytora facilitates property listings for buying, selling, and renting in Dubai.
1.2. All properties listed comply with regulations set by the DLD and RERA.
1.3. Baytora acts as a digital intermediary and is not responsible for ownership or rental agreements.

2. Property Listings
2.1. Listings must provide accurate information, including pricing, ownership, and availability.
2.2. Landlords and agents must ensure listed rental properties comply with Dubai’s tenancy laws.
2.3. Off-plan and freehold properties must be verified under RERA-approved developers or agents.

3. Responsibilities of Renters
3.1. Renters must verify property details and tenancy contracts for compliance with RERA guidelines.
3.2. Renters must use Ejari to register rental agreements with the Dubai Land Department.
3.3. Renters are responsible for timely payments of rent, security deposits, and utility bills as stipulated in their lease agreements.

4. Responsibilities of Landlords
4.1. Landlords must ensure that properties are maintained in a condition suitable for leasing.
4.2. All tenancy contracts must be clear, legally binding, and registered through Ejari.
4.3. Landlords must adhere to RERA’s rental increase cap and provide written notice for any changes to the tenancy terms.

5. Buyer, Seller, and Agent Responsibilities
Buyers:
5.1. Verify property ownership, RERA compliance, and title deeds.
5.2. Fulfill DLD requirements for property transfer and fees.

Sellers and Agents:
5.3. Ensure properties are free from disputes or encumbrances before listing.
5.4. Provide accurate details about ownership and RERA registration numbers.

6. Prohibited Activities
6.1. Misrepresentation of property details or rental terms is prohibited.
6.2. Fraudulent activities, including unauthorized listings or illegal agreements, will result in account termination and possible legal action.

7. Fees and Charges
7.1. Renters and landlords must comply with applicable government fees, such as:

Ejari registration fees.
Any applicable housing fees or municipality taxes.
7.2. Baytora charges service fees for premium listings or marketing services, disclosed at the time of purchase.
8. Liability Disclaimer
8.1. Baytora is not liable for disputes arising between landlords, renters, buyers, or sellers.
8.2. Users are responsible for legal compliance and due diligence during transactions.

9. Data Protection and Privacy
9.1. Baytora adheres to Dubai’s data protection regulations to safeguard user information.
9.2. Personal data is used solely for property-related activities and will not be shared without consent.

10. Governing Law and Dispute Resolution
10.1. These terms are governed by Dubai law and RERA’s regulatory framework.
10.2. Rental disputes are handled by the Rental Dispute Settlement Centre (RDSC). Property disputes are resolved via the Dubai Courts.
